By accessing or using our services, including our website (drivendemandco.com), lead delivery, communications, and related offerings ("Services"), you agree to be bound by the following Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

1. Eligibility

By using our Services, you affirm that you are at least 18 years of age and have the legal authority to enter into this agreement on behalf of yourself or your business.

2. Our Services

Driven Demand Co. specializes in delivering high-quality, pre-screened leads to automotive service businesses, including paint protection film (PPF), vinyl wrap, ceramic coating, window tint, and detailing providers.

We provide:

Exclusive access to real-time, qualified leads

Lead replacement guarantee for unqualified submissions (see Section 4)

Lead delivery via email, Google Sheets, or integrated CRM platforms

We do not:

Handle sales follow-up or close the lead

Guarantee that leads will convert into sales

Conduct outreach or cold calls on your behalf

3. Lead Usage

By purchasing or receiving leads from Driven Demand Co., you agree to:

Use the leads solely for your business purposes

Not resell, redistribute, or share lead data with unauthorized third parties

Follow all applicable privacy laws and ethical contact standards when reaching out to leads

4. Lead Replacement Policy

If a lead is found to be:

Using fake or invalid contact information

Outside your target market or service area

Clearly not interested in the services provided

You may request a replacement within 7 calendar days of delivery. Replacement requests must be submitted with sufficient documentation. All requests are subject to review and approval at our discretion.

5. Billing & Payments

All fees for leads or subscription services are billed according to your plan or agreement. You authorize us to charge your payment method on file. Payments are non-refundable unless otherwise stated in writing or required by law.

Failure to make timely payments may result in suspension or termination of service.

6. Termination

Either party may terminate the relationship at any time with written notice. Upon termination, you will lose access to future lead deliveries and associated services.

You are still responsible for any fees incurred prior to cancellation.

7. Intellectual Property

All content on our website, branding, graphics, copy, and materials provided through our service are owned by Driven Demand Co. or its licensors. You may not reproduce, repurpose, or distribute these materials without prior written permission.

8. Confidentiality

All information shared with you, including leads, internal documentation, or business processes, must be kept confidential. Misuse or unauthorized disclosure may result in legal action.

9. Disclaimers

Driven Demand Co. makes no guarantees regarding the conversion or revenue outcomes of leads. While we vet each contact for quality and intent, we are not responsible for how your team follows up, sells, or services the lead.

We provide the service "as is" without warranties of any kind.

10. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use our Services. Total liability for any claim will not exceed the amount you paid to us in the 30 days prior to the claim.

11. Modifications

We reserve the right to update or change these Terms at any time. We will notify you of material changes via email or website notification. Continued use of our Services constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles. Any disputes must be resolved in the appropriate courts of Colorado.
